Delivery zones:

Deliveries are limited by zones. If your address does not fall within one of our zones, we will not be able to deliver your order. Whether your address falls within a particular zone is up to the sole discretion of Pier 1.

Delivery charge:

Delivery is charge based on the distance the customer is located from the restaurant. Our delivery charges are as follows and Pier 1 reserves the right to modify these charges at its discretion:

0 – 4km     $400JMD

5 – 7km     $500JMD

8 – 14km   $600JMD

Legal Competence:

A customer must be legally competent to order. Any customer who is not legally competent who places any order will not be entitled to returns or refunds. Furthermore, Pier 1 will not be obliged to complete any order for a customer who is not legally competent.

Correct entry of information:

Customers are responsible for the correct entry and updating of their information for order completion.

Payment options:

Accepted payment methods for orders placed through the Pier 1 website include, American Express, Visa and Mastercard Debit/Credit Cards. This is subject to change.

Online Payment:

All online payments are subject to acceptance and successful completion through the Sagicor Bank of Jamaica. Pier 1 accepts no liability for any issues experienced by any customer resulting from the failure of this online payment portal.

Product Availability:

From time to time some products may not be available for sale and Pier 1 is under no obligation to fill any order under such circumstances. Special offers, coupons and the like are not automatically applied and must be specifically selected by a customer when placing an order. Where a customer does not take such action, the full price will be charged on a non-refundable basis.

Maximum order limit:

On a general basis, Pier 1 limits any single order to 10 items, HOWEVER Pier 1 may further decrease this order limitation on an as-needed basis.

Order Acceptance:

Pier 1 is not obligated to accept any order.

In addition to (a) above, all orders whether for carry-out or delivery are subject to the hours of operation. If a customer places an order that cannot be completed within the hours of operation Pier 1 may refuse to accept the order. Pier 1 accepts no liability for the refusal or non-acceptance of any order for any reason.

Cancellations or Amendments by Customer:

Any order placed and confirmed cannot be cancelled or amended once the order is made. An order is not allowed to be placed for future carry-out or delivery.

Cancellations by Pier 1:

Where a situation arises whereby Pier 1 cannot complete a delivery or complete an order for carry-out due to reasons beyond its control, Pier 1 shall not be liable to complete and shall refund the customer for the order value. In this event, a customer is not entitled to any compensation beyond refund in the value of the order.

Website or Phone-line Connectivity Issues:

Pier 1 shall not at any time be liable for difficulties and/or interruptions experienced by customers due to website or phone-line connectivity issues – this shall include delays in order completion.

Order satisfaction:

If you are not completely satisfied with your Pier 1 experience, we will make it right or refund your money. Please consult the Pier 1 ‘Refund Policy’. For the avoidance of all doubt – Pier 1 does not issue cash refunds where the method of payment was not cash.

It is a customer’s sole responsibility to educate and familiarize themselves with Pier 1’s food offerings and make an informed decision on what they choose to order. Pier 1 shall accept no responsibility for any food allergy related incidents. Where a customer is in doubt, please consult a Pier 1 representative.

Amendment to Terms & Conditions:

Pier 1 may amend these Terms & Conditions at any time for any reason.

Applicable Laws & Jurisdiction:

Jamaica.

Severability:

Should any provisions of these Terms and Conditions prove to be unenforceable or invalid, the validity of the remaining provisions shall remain unaffected.

If Pier 1 provides links to other services or entities (such as through advertising on the website), Pier 1 is not responsible or liable for the content or privacy practices of these services or entities.

Trademarks & Copyright:

All content included on this site, such as text, graphics, button icons, images and software, is the property of Pier 1 and is protected by international copyright laws. The content and software on this site may be used as either or both for an informational or shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of the content on this site is strictly prohibited. Pier 1’s graphics, logos and trade names are trademarks of Pier 1 and they may not be used in connection with any product or service that is not affiliated with and approved Pier 1 in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Pier 1.

No person or entity shall use, or cause to be used, any trademark noted on the Pier 1 website without the express written consent of the relevant trademark owner. This shall include trademarks related to Pier 1’s partners and any paid advertisers.

It is a customer’s duty to familiarize themselves with all of Pier 1’s policies, including the Refund Policy. All policies are linked and to be read as one.

Fraud:

Pier 1 shall not at any time be liable for the fraudulent use of any Credit/Debit Cards by a Third Party to pay for orders on its website. Where a customer believes that their Credit/Debit Cards have been so compromised, this must be reported immediately to the issuing bank.

Criminal Acts:

If a delivery driver is involved in any accident, incident or is the victim of criminal activity (or suspected criminal activity) whether directly or indirectly during the course of completing a delivery to any customer, it may be necessary for Pier 1 to reveal certain information provided by a customer to facilitate the delivery to the relevant authorities. Pier 1 will only share information specifically requested by the relevant authorities within the framework of its legal requirement to do so.
